The 2026 UK Influencer Compliance Checklist

Protect your brand, your income, and your reputation.

Before you post your next partnership or sign that new brand deal, run through these six essential checks to ensure you aren't at risk of ASA investigations or CMA fines.

1. The Disclosure Test (ASA/CMA)

  • Is it clear? Use #ad or #advertisement at the very beginning of your caption or overlay.

  • Is it visible? Ensure the tag is not hidden behind the 'see more' button or obscured by the platform's UI (like the 'Like' button on TikTok).

  • Affiliate links – If you earn a commission, you must disclose this clearly. A simple 'afflink' is no longer enough; use 'Commission earned'.

2. The 'Green' Check (Environmental Claims)

  • Is it honest? If a brand claims a product is 'eco–friendly' or 'sustainable', do you have the evidence to back it up?

  • CMA Green Claims Code – Avoid broad, vague terms. If you can't prove it, don't post it.

3. Usage Rights and 'Perpetual' Traps

  • Usage period – Does the contract specify exactly how long the brand can use your face in ads? (e.g. 6 months vs. 'in perpetuity').

  • Exclusivity – Are you accidentally blocking yourself from working with other brands in the same category for too long?

4. Intellectual Property (IP) Ownership

  • Content rights – Do you retain the copyright to your creative work, or is the brand 'buying' it outright?

  • Moral rights – Ensure you have the right to be credited for your work.

5. Payment and 'Net' Terms

  • Payment date – Is the payment term 'Net 30' (30 days after invoice) or something longer?

  • Late fees – Does your contract include a clause for interest on late payments?

6. The 'Exit' Clause

  • Termination – Can you end the contract if the brand’s reputation takes a hit that could damage your own?

  • Force Majeure – What happens if the platform (IG/TikTok) goes down or your account is compromised?
